Legal basis for data processing

The legal basis for processing is consent to data processing in accordance with Art. 6 (1) lit. a DSGVO. There is neither a contractual nor a legal obligation to provide the data. The consent is voluntary. The lawfulness of the processing based on the consent remains unaffected until revocation.

If the use in the social media channels has been consented to, the consent also expressly applies to data transfers to the USA in accordance with Art. 49 (1) a DSGVO. Extensive information about the risks involved was provided in the declaration of consent.

The legal basis for the publication of photos for public relations on media of the HWR Berlin media (print, HWR website) on occasions of higher rank, e.g. for representative events is Art. 6 para. 1 p. 1 lit. e DSGVO (public task) in conjunction with §6 para. 1 (12) BerlHG / §4 para. 4 BerlHG.

Storage of data and deletion periods

  • The data is deleted from the Internet pages after 10 years.
  • Deletion from print media is no longer possible after the medium has been issued. Before going to print, the media would be amended by the data subject to revocation of consent.
  • In the official social media channels (such as Facebook, Instagram, YouTube, Twitter) of the HWR Berlin, personal data (video, photo) will be deleted after 10 years. Deletion of shared posts by other platform users is not possible.

In addition, the data will be deleted as soon as the consent is revoked or the right to delete the data according to Art. 13 (2) b DSGVO is exercised.

Scope of the processing of personal data

As a matter of principle, we process personal data of our users only to the extent necessary.

Recipients or categories of recipients of the personal data

A transmission of the above personal data to third parties outside the university (external recipients) can take place if consent has been given. It’s about them.

Provider of the official social media channels of the HWR Berlin. Inside the university (internal recipients), the data can be processed by the university communications team, by the IT department and, if consent has been given, also by the press office.

Transmission of the data to a third country or an international organization

Rights of the data subject

The person affected by the processing has rights in accordance with Art. 13 – 23 GDPR, which can be asserted against the HWR Berlin. An overview of the most important rights is listed below:

  • Right to information about data stored by the person responsible (HWR Berlin) according to Art. 15 DSGVO
  • Right to correction of data stored by the person responsible according to Art. 16 DSGVO
  • Right to deletion of data stored by the person responsible according to 17 DSGVO
